Terms and Conditions of Use

Welcome to WishSpread. By downloading, accessing, or using our mobile application and associated services (hereinafter, the "Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, then you may not access the Service.

1. Description of the Service

WishSpread is a platform designed to help users create and organize wishlists for events (weddings, birthdays, etc.), automate product data extraction via links (scraping), and manage gift reservations among guests to avoid duplicates. The Service includes real-time cloud synchronization and options for sharing lists publicly or via direct links.

2. User Accounts

To use certain features of WishSpread (such as creating lists, cloud sync, and reserving gifts), you must create an account.

You are responsible for safeguarding the password or authentication methods that you use to access the Service and for any activities or actions under your account.
We reserve the right to suspend or terminate your account at any time and for any reason, including without limitation, a breach of these Terms or misuse of generated links.

2.1. Minimum Age and Registration

The Service is intended for individuals over 16 years of age (or the legal minimum age in their country). By registering, the user guarantees that they meet this requirement. Likewise, the user has the inalienable right to request the permanent deletion of their account and all associated personal data through the Application's settings options or via the provided 'Delete Account' link.

3. User-Generated Content

Our Service allows you to add product links, descriptions, event titles, and images ("Content").

Ownership and Responsibility: By adding a link from an external store, you declare that its use is strictly personal and informative. You are responsible for ensuring that the text and images you upload manually do not infringe on third-party copyrights.
Shared Lists: If you share the link to your wishlist, you authorize anyone with access to that link to view the desired products and make anonymous reservations through our platform.

4. Affiliates, Prices, and Third-Party Stores (Critical Disclaimer)

WishSpread acts as a visual organizer and intermediary, but is NOT an online store. Please keep the following in mind:

Price and Availability Discrepancies: Our system extracts the price and product image at the exact moment you add the link. However, prices and stock can change on the original store (e.g., Amazon, Zara) without prior notice. WishSpread does not guarantee that the price displayed in the app will match the final checkout price on the external store.
Affiliate Links and Monetization: As an Amazon Associate and participant in other affiliate marketing programs, WishSpread earns from qualifying purchases. Some product links on our platform may be automatically converted into affiliate links.
Purchase Liability Exemption: WishSpread does not process payments, handle shipping, or manage returns. Any issues with a gift, a payment, or a shipment must be resolved directly with the external store where the purchase was made.
Reservation Management: The function to "reserve" or "mark as purchased" a product is a coordination tool between users. WishSpread does not guarantee that a user who has marked a product as "purchased" will actually complete the transaction in the external store. We are not responsible for duplicate or unpurchased gifts.

5. Intellectual Property

The Service and its original content (excluding Content provided by users and metadata/images extracted from third-party stores for preview purposes), features, and functionality are and will remain the exclusive property of WishSpread and its licensors. The application, its logo, icons, and source code are protected by copyright and other intellectual property laws.

6. Limitation of Liability

In no event shall WishSpread, nor its developers, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to the Service, undelivered gifts, failed purchases on third-party sites, or interruptions in our database availability.

7. Changes and Governing Law

We reserve the right to modify these Terms at any time. These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

8. Notification of Changes

We reserve the right to update these terms. If the changes are significant, we will notify users through the Application or by email. Continued use of the Service after a modification constitutes acceptance of the new Terms.
